Patentability and Commercial Value Must Remain Distinct

Article 22 of China's Patent Law requires novelty, inventiveness, and practical use. Practical use means that an invention can be manufactured or used and can produce positive results. It is a test of technical applicability, not a forecast of revenue, market size, or investor returns. Article 26 separately requires a clear and comprehensive description sufficient to enable a person skilled in the relevant field to carry out the invention (CNIPA, Patent Law of the People's Republic of China).

This boundary serves an important purpose. A foundational invention with no obvious market today may become the basis of a major industry tomorrow. A fashionable technology may lose its value because of cost, regulation, or a superior substitute. Conclusion: The Patent Office as an Interface, Not an Omnipotent Planner

Constructive reform does not require dismissing the achievements of the patent system or expecting patent examiners to become engineers, investors, and entrepreneurs at the same time. The most valuable institutional upgrade would be to develop the patent office from a rights-examination authority into a trusted and transparent interface within the national innovation network. On one side are inventors' rights and technical disclosures. On the other are enterprise demand, validation facilities, capital, industrial parks, and public procurement.

The principle is not to grant patents only to inventions that experts believe will be valuable. It is to ensure that every invention meeting the law receives equal access to protection, while technologies whose owners voluntarily seek validation and demonstrate genuine potential receive a faster opportunity to reach society. Statutory examination must remain neutral. Value assessment must remain optional. Expert judgment must be constrained. Public funding must follow milestones. Trade secrets must be respected, and commercialization outcomes must be evaluated over time.

When an innovation system begins to measure the problems solved, products created, and social value delivered, patent volume can become genuine national capability. The patent office cannot carry the entire innovation system, but it can become one of the most important places where invention stops being a document and starts becoming progress.
